At Swcegroup, we want you to be satisfied with your purchase. This Return and Refund Policy explains your statutory rights under French law as well as our additional 30-day commercial return policy.
In addition to your statutory consumer rights, Swcegroup offers a 30-day commercial return period for eligible products.
The 30-day period begins on the date you receive your order.
To be eligible for a commercial return, the item should be returned in its original condition, unworn, unused, unwashed and with any original tags or packaging still attached where applicable.
Products that have been damaged, altered, washed, worn beyond reasonable inspection, or otherwise used may not qualify for a commercial return, except where the return concerns a defect or a lack of conformity covered by applicable French law.
Before sending an item back, please contact us at hello@swcegroup.com and provide your order number and the reason for your return.
Our customer service team will provide the applicable return instructions and return address.
Please do not send a return to the address shown on your order confirmation unless our customer service team has specifically instructed you to do so.
For a voluntary commercial return that is not related to a defective or non-conforming product, the customer is generally responsible for the return shipping costs unless otherwise stated by Swcegroup.
If a product is defective or does not conform to the sales contract, applicable French legal protections may apply and the costs associated with bringing the product into conformity will be handled in accordance with applicable law.
For distance purchases, consumers in France generally have a statutory right of withdrawal of fourteen (14) calendar days without having to provide a reason, subject to the exceptions provided by French law.
The withdrawal period generally begins on the day the consumer, or a third party designated by the consumer other than the carrier, receives the goods.
To exercise this right, you must notify Swcegroup of your decision to withdraw before the applicable 14-day period expires. You may contact us by email at hello@swcegroup.com.
After notifying us of your withdrawal, the goods must generally be returned within fourteen (14) days, in accordance with applicable French law.
Where the statutory right of withdrawal applies, Swcegroup will process the refund in accordance with the applicable provisions of the French Consumer Code.
The refund will generally include the payments received from you, including the applicable standard delivery costs. Where permitted by law, additional delivery costs resulting from your choice of a more expensive delivery method may not be refunded.
Swcegroup may defer the refund until the returned goods have been received or until you provide evidence that the goods have been sent back, whichever occurs first, where permitted by applicable law.
Refunds will generally be made using the same payment method used for the original transaction, unless another method has been expressly agreed with you.
Consumers may handle and inspect goods only to the extent necessary to establish their nature, characteristics and functioning, subject to applicable French law.
Where a consumer has handled the goods beyond what is necessary for such inspection, the consumer may be liable for any resulting depreciation to the extent permitted by French law.
Certain products may be excluded from the statutory right of withdrawal where an exception under French law applies, including certain personalized or made-to-order products.
If a specific product is subject to a statutory exception, the applicable information will be provided before or at the time of purchase.
If you receive an item that is damaged, defective or does not conform to the sales contract, please contact us as soon as reasonably possible at hello@swcegroup.com.
Please provide your order number and, where useful, photographs or other information describing the issue so that we can review your request efficiently.
Your statutory rights are not affected by our 30-day commercial return policy.
Consumers purchasing from a professional seller benefit from the legal guarantee of conformity provided by the French Consumer Code.
Under applicable French law, the legal guarantee of conformity generally applies for two years from the delivery of the goods, subject to the conditions and provisions established by law.
Where a lack of conformity is established, the consumer may have statutory rights including repair or replacement, and in circumstances provided by law, an appropriate price reduction or termination of the contract.
These legal rights cannot be excluded or limited by this commercial return policy.
Consumers may also benefit from the legal guarantee against hidden defects under Articles 1641 and following of the French Civil Code, subject to the conditions established by French law.
This legal guarantee applies to hidden defects that make the product unfit for its intended use or substantially reduce its intended use, as provided by law.
The exercise of statutory guarantees is separate from and is not limited by our 30-day commercial return policy.
This Return and Refund Policy is intended to comply with applicable French consumer protection and e-commerce legislation, including the French Consumer Code (Code de la consommation) and the French Civil Code (Code civil).
Nothing in this policy is intended to exclude, restrict or replace any mandatory consumer rights provided under French law.
Where a mandatory provision of French consumer law applies, that provision will prevail over any conflicting provision of this commercial return policy.
